These Terms of Service ("Terms") govern your access to and use of the gacha and spin features of the Nifty Island platform, websites, and applications (collectively, the "Service"), operated by Nifty Island LLC ("the Company," "we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you may not access or use the Service.
IMPORTANT: THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION AND A WAIVER OF CLASS AND COLLECTIVE ACTIONS (SECTION 18), WHICH AFFECT HOW DISPUTES ARE RESOLVED. PLEASE READ THEM CAREFULLY.
1.1. The Service allows you to obtain randomized digital items ("Items") through a spin mechanic, either by purchasing individual Spins or by holding a Premium Subscription. Certain Items may be designated as transferable and may hold value on secondary markets, and certain Items are, or entitle you to, an authenticated physical trading card, as described in these Terms.
1.2. By accepting these Terms, you confirm that you have read and understood them and that you enter into a binding agreement with us. We may amend these Terms from time to time. The current version and its effective date appear above, and your continued use of the Service following any change constitutes acceptance of the amended Terms.
a. "Customer Account" means the account you register to access the Service.
b. "Item" means a digital item obtained through the Service. An Item may be an "In-Game Item," usable only within the Service, or a "Tradeable Item," which may be transferred, sold, or withdrawn as described in Section 8. Certain Items are, or entitle you to, a Physical Card, as described in Section 9.
c. "Physical Card" means an authenticated physical trading card that an Item may represent or entitle you to, which is supplied, held in custody, and fulfilled by the Supplier.
d. "Premium Subscription" means the recurring membership described in Section 6.
e. "Spin" means a single purchase-and-reveal of a randomized Item from a defined pool.
f. "Supplier" means RIPDOTFUN, Ltd., the third-party supplier and fulfillment provider that sources, authenticates, holds in custody, ships, and delivers Physical Cards, as described in Section 9.
g. "Wallet" means the digital-asset wallet you use to transact with the Service.
3.1. By accessing or using the Service, you represent and warrant that you:
a. are at least 18 years of age, or the age of majority in your jurisdiction, whichever is higher;
b. are not identified on any applicable sanctions, embargo, or denied-persons list;
